Lawsuit calls Florida's license plate law unconstitutional amid citations

A lawsuit filed by Ticket Toro alleges that Florida’s new law prohibiting anything that blocks or covers a license plate, including dealership frames, is unconstitutionally vague. The law, Florida Statute 320.061, bans “altering” or “mutilating” plates but lacks clear definitions, leading to inconsistent and potentially arbitrary enforcement by law enforcement. Ticket Toro argues this vagueness violates the Due Process Clause, as drivers lack clear guidelines on what actions could result in criminal charges. The company seeks a statewide injunction to halt enforcement and expunge existing citations. They cite a case where a driver was arrested for a decorative frame that obscured a state name, an arrest later deemed invalid due to the statute’s ambiguity.
