Democratic lawmakers are warning governors in states like Arizona and California that they are inadvertently providing U.S. Immigration and Customs Enforcement (ICE) warrantless, ‘frictionless’ access to state DMV data. The data sharing occurs through Nlets, a national law enforcement network, which facilitates millions of queries annually without state oversight. Lawmakers argue this practice enables mass surveillance, potentially feeding DMV photos into ICE’s facial recognition apps like Mobile Fortify. They are urging governors to block this direct access, forcing federal agencies to submit reviewable data requests for legitimate criminal investigations. The letter highlights that several states, including Illinois and New York, have already implemented such restrictions, proving that states have the power to protect residents’ privacy from federal overreach.
