Immigration and Customs Enforcement (ICE) is using a new mobile facial recognition app, ‘Mobile Fortify,’ to verify identities and immigration status in the field. According to an internal Department of Homeland Security (DHS) document, individuals approached by agents cannot refuse to be scanned. The policy applies to everyone, including U.S. citizens, and the photos are stored for 15 years regardless of the person’s status. This practice represents a significant expansion of warrantless biometric surveillance by federal agencies, creating a digital dragnet where people can be compelled to submit to a facial scan without any suspicion of wrongdoing. The program raises serious due process and privacy concerns, as it normalizes compulsory biometric data collection in public spaces and retains the data of citizens and non-citizens alike for over a decade.
